In penal colony № 62 in Ivdel of Sverdlovsk region illegal practice has come about when attorneys and human rights defenders are not allowed to have normal chances to meet with convict in order to give legal help instead officers put defenders into rooms for short meetings where they have to communicated with prisoners through glass window under supervision of jailers. There is no even a hole for exchanging documents. No windows, stuffiness.
These conditions are considered standard by administration. Moreover- there is only one room for short meeting and it causes conflicts among human rights defenders and family members of convicts. In their opinion when defenders take the room, they obstruct meetings of convicts with relatives.
Exactly in such conditions attorney Roman Kachanov had a meeting with convict Roslov in December of last year. On written and oral claim of to bring this convict here for legal consultation confidentially, Roman Kachanov got denial. This refusal meant impossibility to discuss important issues with convict which are attorney secrets. We had to disclose IvdelLAG rules within court over again, but in Yekaterinburg court where they don’t get used to such arbitrariness like in Ivdel court.
Yesterday on April 9, 2014 court hearing took place upon this case. Expert Council member under the Ombudsman of the Russian Federation Aleksey Sokolov and member of Public Monitoring Committee Larisa Zakharova have testified during court hearing.
They completely confirmed that meetings with human rights defenders take place only in short meetings room non confidentially with listening devices.
In the end Verkh-Isetsky court of Yekaterinburg chaired Evgeniya Savelieva handed down a decision to the advantage of defenders. Actions of warden of colony № 62 Procenko are found unlawful over denial of access.
