Noncommercial partnership «Assistance in legal help for citizens «LEGAL BASIS», «Transregional center of human rights», Fund «For convicts’ rights protection» and members of the Sverdlovsk Public Monitoring Committee have addressed to Director of the Federal Service for Execution of punishment — G.N. Korniyenko because of terrible situation at the penal colony № 5 of Nizhny Tagil.
Within recent years convicts of this facility are subjected to inhuman tortures and other forms of humiliating treatment.
Horrible facts of tortures towards prisoners are well known by state bodies, prosecutor office, the Federal Service for Execution of punishment in Sverdlovsk region.
Human rights defenders always file petitions and claims into Investigative bodies, prosecutor office and the Federal Service for Execution of punishment in Sverdlovsk region but situation hasn’t changed.
On 20 June 2014 members of Committee and the representatives of human rights organizations of the Sverdlovsk region filed a petition into the Federal Service but required measures were not taken. At the colony convicts are kept being beaten.
Here are some facts which have been found by defenders during inspection of the facility.
Jailers apply tortures towards those convicts who write complaints and fight for their rights, for example such tortures: hanging with handcuffs to grille in solitary.
There is illegal practice to fight with undesirables like detainment of convicts into cage for dogs; pouring with cold water on the frost.
After convicts ask defenders for help, they go through physical violence.
It happens also with citizens of other countries.
Members of Public Monitoring Committee are not given log № 1 «Records of crimes», log № 1 «Records of incidents» and log about the application of physical force and special means. Medical workers refuse to record bodily injuries on convicts.
Chief of the colony Y. Laptev obstructs work of lawyers, he forbids to bring cameras and didn’t let defenders on meetings with prisoners.
Last incident with beating of a citizen of Kyrgyzstan Z.S. Egemberdiyev and refusal of doctor R.V.Platonova to record bodily harm show absence of Law in there.
Thus, we can say that neither chief of the penal colony № 5 nor Federal Service for Execution of punishment can change existing torture system against convicts by officers of the facility.
Reputation of penitentiary system of the Sverdlovsk region is falling down with huge speed.
The representatives of human rights organizations and members of Committee have sent a petition to conduct investigation and stop torture practice at the facility.
