On 12 May 2015 riots took place at the penal colony-2 in the Republic of Bashkortostan. Approximately 300 convicts protesting against tortures and humiliation by “convicts-activists” went out and refused to leave the ground. Part of the convicts (20 people) climbed the roof and hung out a poster “Stop torture”.
It is worth to say that all the convicts have been employed, abided by law demands. They were not law breakers and characterized to be generally good.
As a result, 20 people have been found with bodily injuries. the Federal Service for Execution of punishment takes steps to wrench the truth. They try to lay responsibility on three inmates who are not “activists”. Now those convicts have been transferred into the pretrial detention center-1 in Ufa.
The same day “task-force” from Public Monitoring Committee (O.S. Galin, A.A. Dremina, Z.I. Bulatova and O.V. Deryabin) made their ways there.
After they had conducted inspections, protest stopped. Many of convicts agreed to tell about human rights’ violations, power of “activists” at the facility. Then convicts came back into their calls where they wrote complaints to the Chairman of Public Committee, in total about 300 ones.
On 18 May 2015 a working group consisting of lawyers Roman Kachanov, Fedor Akchermushev and Director of Association “Legal Basis” Aleksey Sokolov arrived in Ufa where they met with deputy chairman of Public Monitoring Committee Zilya Bulatova and lawyer Oleg Maksimenko.
After having discussed situation defenders went to the pretrial detention center-1 where Zilya Bulatova and Oleg Khetchikov checked detainment conditions for inmates arrived there before.
Lawyers Oleg Maksimenko, Roman Kachanov, Fedor Akchermushev at the front office wrote demands and Aleksey Sokolov filed an application on a meeting with inmates to check facts of human rights’ violations.
At the entrance officers ordered to leave their briefcases and bags there, defenders were allowed to have only pen and paper to write on. Sverdlovsk lawyers were surprised with new rules. But they did it or otherwise they couldn’t get inside.
Director of Association “Legal Basis” Aleksey Sokolov was not permitted to have a meeting due to absence of Prison Head and nobody else could do it instead of him.
Members of Public Monitoring Committee in the course of inspection didn’t find any violations. Convicts did not complain. Lawyers questioned three inmates and after conversation it was obvious that officers make them guilty of riots on 10 May 2015.
The reason was special part of the inmates who is endued with administrative duties (“convicts-activists”). These convicts can be senior officer -on duty, assistants of senior officer-on duty, stores’ keeper etc; they take advantage of it and torture, beat and rape inmates. They extort money from inmates.
Facility administration doesn’t take any measures to stop law violations and cruelty by convicts in fact wardens encourage them and grow negative atmosphere.
Thus, administration of the penal colony-2 showed its incompetency; it endued inmates with duties and power, and as a result prison is turned into criminal facility where sexual violence, tortures, extortion and humiliations are common things. Meanwhile Bashkortostan Federal Service also showed unwillingness to figure it out, remedy the situation.
Conclusion of the working group:
Despite ban for self-regulating organizations at the penitentiary facilities, convicts fulfill orders of administration. Once they get this authority, convicts use it to commit crimes further. Put another way: there is merging of prison officers and criminals, when authorities use criminal powers to achieve their goals.
